Eligibility, authority and electronic communications
You must be at least 18 years old and legally capable of entering into a contract. If you act for a company or organisation, you confirm that you are authorised to place the Order and bind that entity.
You agree that quotations, order acknowledgements, proofs, approvals, invoices, notices and other communications may be created, accepted and delivered electronically. You are responsible for keeping your email address, telephone number and other contact details accurate and for checking messages relating to your Order.
An electronic acceptance, approval, checkbox selection, payment instruction or written message may be treated as your instruction to proceed.
Website use and customer accounts
You may use the Website for lawful personal or business purposes, including browsing Products, requesting quotations, preparing designs and placing authorised Orders.
- Do not copy, scrape, republish, resell or commercially exploit Website content, templates or data without permission.
- Do not interfere with Website security, payment systems, servers, accounts or other users.
- Do not use automated tools in a way that creates an unreasonable load or disrupts the Website.
- Do not attempt to gain unauthorised access, reverse engineer online tools or introduce malicious code.
You are responsible for activity under your account and for keeping login credentials confidential. Notify us promptly if you suspect unauthorised use. We may require identity or authority verification before changing account, payment or delivery information.
Product information, pricing and availability
We aim to describe Products, materials, sizes, finishes, quantities, production estimates and delivery options accurately. Product images, screen previews and colour samples are illustrative and may not show exact colour, texture, thickness, scale or finishing.
Unless stated otherwise, prices are in Malaysian Ringgit (MYR). The final payable amount will include the charges shown at checkout or in the accepted quotation, including applicable delivery charges, taxes and approved extras.
Materials, machines, production capacity and third-party supplies are subject to availability. If an item becomes unavailable, we may propose a reasonable alternative. We will seek approval before a materially different substitution where practicable.
Quotations, Orders, corrections and contract formation
A quotation is valid only for its stated validity period and may be revised if the specification, quantity, material, delivery address, artwork or production requirement changes.
Submitting an Order is an offer to purchase. An automated email or order number confirms that we received the request; it does not necessarily mean that the Order has been accepted for production.
An Order is accepted when we confirm acceptance, verify the required payment and Artwork, or begin the agreed work. We may reject an Order before acceptance because of an obvious error, unavailable material, unsupported specification, suspected fraud, unlawful content or another reasonable production or legal concern.
Correcting an Order
You should review the cart, product options, Artwork and addresses before submission. Contact us immediately after submission if you notice an error. Corrections are subject to Clause 15 and may no longer be possible after production begins.
Customer Artwork, content and intellectual property
You retain any rights that you lawfully hold in Customer-supplied Artwork. You grant Image Magic a limited, non-exclusive licence to open, inspect, adjust for production, reproduce, print, finish, pack and deliver the Artwork, and to provide it to approved employees, suppliers or service providers only as reasonably required to fulfil and support the Order.
You confirm that you have the necessary rights, permissions and authority for all Artwork, including logos, trademarks, photographs, fonts, personal data, mailing lists, music or media references, QR destinations, barcodes and other third-party content.
You are responsible for claims arising directly from content you supplied without the required rights or authority, to the extent permitted by law. We may request evidence of permission and may suspend or reject an Order if rights are uncertain.
Image Magic content, templates and online design tools
Website text, graphics, product photographs, layouts, software, templates and original content are owned by Image Magic, licensed to Image Magic or used with permission. No ownership is transferred except for the limited right to use the Website and receive completed Products.
Standard templates and design elements are provided on a non-exclusive basis and may be used by more than one Customer. Customising a template does not give you exclusive ownership of the underlying template or platform element.
We will not intentionally make your private logos, names, photographs or confidential Customer content available to other Customers as a template without permission.
Online design previews are visual aids and are not exact colour, material, cutting or finishing proofs. Save your own files regularly; we cannot guarantee recovery of unsaved browser-based work.
Prohibited or restricted content and Orders
We may refuse, pause or cancel work that we reasonably believe is unlawful, fraudulent, infringing, unsafe or contrary to our policies. This includes content involving:
- Copyright, trademark, privacy or personality-right infringement.
- Counterfeit branding, deceptive packaging or unauthorised official marks.
- Fraudulent certificates, identification cards, permits, tickets or documents.
- Defamation, threats, harassment, hate, obscenity or unlawful discrimination.
- Illegal goods, unlawful promotions, malicious code or instructions that create legal or safety risk.
- Personal data used without proper authority or consent.
If an Order is rejected because of Customer-supplied content, any refund may be reduced by reasonable payment, design, material or production costs already incurred, to the extent permitted by law.
Artwork specifications, checks, proofs and approvals
Artwork must follow the product size, bleed, safe-area, resolution, colour-mode, page-order and file-format requirements shown on the product page, template or Artwork guide.
Our standard prepress check is a basic technical review. Unless a separate paid service is agreed, it does not include proofreading, translation, legal review, design correction, fact checking or verification of names, dates, prices, telephone numbers, addresses, QR destinations or other Customer information.
If a proof is supplied, you must review all content, layout, page order, quantity, size and specifications. Approval authorises production. Changes requested after approval may require a new quotation, additional payment and a revised schedule.
Where no separate proof is supplied, submission of print-ready Artwork may be treated as approval to print that file. Routine technical processing, such as imposition or file conversion, may not be separately proofed.
Colour, material, cutting and finishing tolerances
Commercial printing and finishing involve reasonable production tolerances. The following are not normally defects when they remain within reasonable commercial limits:
- Differences between screen colour and printed CMYK colour.
- Minor colour variation between separate batches, machines or materials.
- Minor variation in cutting, folding, creasing, alignment, binding, lamination, print position or finished dimensions.
- Natural variation in paper, fabric, vinyl, board, wood, acrylic or other material colour, texture and thickness.
- Changes caused by lamination, coating, lighting, surface reflection or the colour of the printing material.
Customers requiring precise colour matching, strict positioning or a specific material appearance should request a physical proof, sample or written tolerance before full production. Additional charges and time may apply.
QR codes, barcodes, numbering and variable data
You are responsible for the accuracy, completeness, sequence and lawful use of data supplied for names, addresses, numbering, barcodes, QR codes, tickets, certificates, labels and other variable-data work.
You must review any sample, data map, numbering range or proof provided. We are not responsible for errors already present in Customer-supplied data, inactive or changed URLs, duplicated records or incorrect numbering instructions.
QR codes and barcodes should be tested at the final printed size and on the intended material. You remain responsible for maintaining the linked website, form, payment page or destination after printing.
Payment, verification and invoices
Unless approved credit terms are agreed in writing, full payment is required before production. Available methods may include card, online banking, supported e-wallets, bank transfer, cash deposit, DuitNow QR or an approved cheque. Cash on delivery is not normally available.
Manual transfers and cheques are not confirmed until cleared funds are verified. Payment proof is evidence of a transaction request but does not by itself release an Order for production.
Underpayments place the Order on hold. Overpayments or duplicate payments will be reviewed and corrected through an appropriate refund or agreed adjustment. Do not make a second payment while the first transaction is uncertain.
Eligible invoices and receipts are issued according to the Order and payment status. Billing details should be checked before the final invoice is issued.
Production times, urgent Orders and outsourcing
Production estimates begin only after payment is verified, final Artwork is approved and all required specifications and information are complete. Production time is separate from courier transit time.
Turnaround estimates may be affected by quantity, material availability, finishing, drying or curing, variable data, proof approval, equipment interruption, public holidays, supplier schedules and current production capacity.
An urgent or fixed completion date is binding only when accepted by Image Magic in writing. Entering an event date in remarks does not automatically create a guaranteed deadline.
We may use approved production suppliers, specialists, couriers and subcontractors to fulfil an Order. We may provide them with the Artwork and information reasonably required for that purpose, while remaining responsible to the extent required by law.
Order changes and cancellations
Contact us immediately if you need to change or cancel an Order. A request may be accepted only before the affected work has entered production.
An Order may no longer be changeable or cancellable after Artwork is released, custom material is ordered or prepared, printing or finishing begins, personalisation or numbering starts, or work is transferred to a production supplier.
Where a cancellation is accepted before production, reasonable payment-gateway, design, proof, material and work costs already incurred may be deducted from the refundable amount.
If Image Magic must cancel an unproduced item because we cannot supply it, we will offer an appropriate alternative or refund the amount paid for the affected item.
Delivery, tracking and failed delivery
Delivery methods and charges depend on destination, actual or volumetric weight, packed dimensions, product type and service availability. The delivery option and charge shown at checkout or in the accepted quotation apply to the Order.
Delivery estimates begin after production, quality checking, packing and courier collection. They are estimates rather than guaranteed arrival dates unless expressly accepted in writing.
You must provide a complete address, postcode, recipient name and active contact number. Address changes after dispatch may be unavailable and may cause extra charges or delay.
The recipient must respond to courier communications and arrange redelivery or collection after a failed attempt. Costs caused by an incorrect address, refusal, repeated attempts, storage, return-to-sender or reshipping may be charged to the Customer.
Report visible damage, missing parcels or unusual tracking delays promptly and retain all packaging. Claims are handled under Clause 19 and the linked Return Policy.
Self-collection and uncollected Orders
Wait for a ready-for-collection notice before travelling to Image Magic. Provide the Order number and arrange a suitable vehicle or authorised collector for large or heavy items.
Where reasonably possible, check the number of packages at collection. Product-quality claims remain subject to the applicable claim period.
Unless another period is stated in the ready notice, collect the Order within 30 days. If it remains uncollected, we may issue a further notice, charge reasonable storage costs, or after a reasonable period recycle, dispose of or otherwise deal with the custom goods as permitted by law. Custom-made goods are not automatically refundable because they were not collected.
Singapore and international Orders
International delivery is available only for eligible Products and destinations accepted by Image Magic. Eligible Singapore Orders are normally shipped using DHL Express.
Unless expressly included at checkout or in the quotation, the recipient is responsible for import GST, duties, customs-clearance fees, courier disbursement charges, permits and other destination-country charges.
You must provide accurate customs and recipient information and cooperate with courier or customs requests. We will declare the actual product description and commercial value and will not falsely describe an Order as a gift or understate its value.
Customs inspections, recipient payment and government procedures may extend delivery time. Refused or unclaimed international shipments may incur return, storage, customs and reshipping costs.
Returns, reprints, replacements and refunds
Most Products are custom-made. Change-of-mind returns, preference-based exchanges and refunds for Customer selection or approved Artwork errors are not normally available after production begins.
A claim may be considered for a confirmed production defect, incorrect item, packing shortage, material delivery damage or shipment confirmed lost by the appointed courier.
Notify us within seven calendar days from the recorded delivery date and provide the Order number, description, affected quantity, clear photographs or video, and packaging or courier-label evidence where relevant. Keep the affected Products and packaging until the review is completed.
Depending on the circumstances, an approved remedy may include correction, reprint, replacement, partial refund, full refund of the affected item or another reasonable solution. Do not return Products without written authorisation.
File retention, confidentiality and personal data
Image Magic does not provide permanent Artwork storage. Files, proofs and production records may be retained for operational, accounting, legal and support purposes and may later be archived or deleted. You must keep your own original, editable and print-ready files.
We take reasonable steps to protect non-public Customer information and will use or disclose it as needed to process payment, produce, outsource, deliver, support and legally record the Order.
If Artwork contains personal data, you confirm that you are authorised to provide and instruct us to process it. This is particularly important for names, photographs, contact lists, certificates, identification data, race information and variable-data printing.
We will not intentionally offer your confidential Customer Artwork to other Customers as a template. Public portfolio or promotional use of identifiable Customer Artwork should be based on permission or another lawful basis.
Third-party services, external links and Website availability
The Website may use or link to payment gateways, banks, e-wallets, couriers, maps, social platforms, file-transfer services, manufacturers and other third parties. Their independent services are also governed by their own terms and privacy practices.
We take reasonable care to maintain the Website and files supplied through it, but no online service can be guaranteed to be uninterrupted, compatible with every device or entirely free from harmful code. Use current browser and security software and keep your own copies of important files.
General Website information may be corrected or updated. Product-specific specifications, accepted quotations, approved proofs and Order confirmations take priority where they clearly differ.
Events outside reasonable control
Neither party is responsible for delay or failure caused by events beyond reasonable control, including natural disaster, flood, fire, epidemic, war, civil disorder, government restriction, utility or internet outage, major equipment failure, labour disruption, transport interruption, courier disruption or supplier shortage.
The affected party should take reasonable steps to reduce the impact and resume performance. If the event makes an unproduced part of the Order impossible for an extended period, the parties may agree on a revised schedule, alternative supply or cancellation and refund of the affected unproduced portion as required by law.
Liability, Business Customers and statutory rights
Nothing in these Terms excludes or restricts liability or any guarantee, right or remedy that cannot lawfully be excluded, including applicable Malaysian consumer protections.
Image Magic is not responsible for loss caused by inaccurate Customer Artwork or instructions, late payment or approval, an incorrect address, Customer-selected unsuitable specifications, an unmaintained QR destination, or use of a Product contrary to stated instructions, except to the extent the loss was caused by Image Magic or responsibility cannot legally be excluded.
For Business Customers only, and to the fullest extent permitted by law, Image Magic's aggregate liability arising from an affected Order is limited to the amount paid for the affected Product or Service. Image Magic is not liable to a Business Customer for indirect or consequential loss, loss of profit, business interruption, missed-event costs or third-party contractual penalties, unless otherwise required by law or expressly accepted in writing.
Customers should take reasonable steps to reduce avoidable loss and should not schedule critical distribution, installation or events without allowing a reasonable production and delivery buffer.
Suspension, termination and refusal of service
We may suspend an account, payment, upload or Order where reasonably necessary to investigate fraud, security, unlawful content, non-payment, abusive conduct, misuse of the Website or breach of these Terms.
We may refuse service where a request creates legal, safety, staff-welfare, production or reputational risk. Where appropriate, we will explain the reason and deal fairly with amounts paid for unproduced work, subject to reasonable costs already incurred and applicable law.
Suspension or termination does not affect rights, payment obligations, confidentiality duties or claims that arose before it took effect.
Complaints, governing law and dispute resolution
Please contact Image Magic first and provide the Order number, facts and requested resolution. We will review the matter in good faith and may request supporting evidence.
These Terms and Orders are governed by the laws of Malaysia. Subject to any mandatory consumer right, the Malaysian courts have jurisdiction over disputes that are not resolved directly.
A Consumer may also have the right to seek assistance or file a claim through the Tribunal Tuntutan Pengguna Malaysia (TTPM) or another competent authority. Nothing in this clause removes a legal right to use an available consumer-redress process.
Changes to these Terms and general provisions
Updates
We may update these Terms for future Website use and Orders. The version accepted when an Order is confirmed will normally govern that Order, unless a change is required by law or expressly agreed by both parties.
Severability and waiver
If a provision is invalid or unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver of that right.
Assignment and subcontracting
You may not transfer an Order or contractual right without our consent. We may assign or subcontract operational obligations, but this does not remove responsibility that remains with us under applicable law.
Entire agreement
These Terms, the accepted quotation or Order, approved proof, product specification and linked policies form the agreement for the Order and replace earlier discussions about the same subject, except for an express written variation.
Language versions
The Bahasa Malaysia, English and Chinese versions are intended to have equivalent meaning. Any ambiguity should be interpreted consistently with applicable Malaysian law and the version presented and accepted for the relevant transaction.
Contact information and related policies
Questions about these Terms or an Order may be sent to Image Magic using the contact information at the end of this page. Include your Order or quotation number when the enquiry concerns an existing transaction.
These Terms should be read together with the related policies linked below. The more specific policy applies to its subject matter, while these Terms continue to apply to the remainder of the relationship.
Questions about these Terms?
